Summary
Where does legal authority reside when public power operates through data, code and models? This chapter introduces the Intelligent Legal Condition: a diagnostic account of an environment in which legality depends on the integrity of the complete process through which an institution acts. It locates the ‘seam’ where authoritative language becomes computational conditions and where computational outputs acquire institutional effect. A functional reading of technological development directs attention to provenance, relationships and consequences rather than changing technology labels. Through conceptual distinctions, administrative illustrations and engagement with rival accounts of technological change, the chapter traces legality from source and interpretation through encoding, execution, evidence, review and correction. Its threshold safeguard is the Capacity–Authority Distinction: technical capability does not confer lawful power. The account neither attributes consciousness or sovereignty to machines nor assumes existing law is powerless; applicability thresholds and specific duties remain for later chapters.
